Refund Policy

This Policy sets out how refunds are handled for UniMessenger software licences and forms an integral part of the Terms of Service.

1. Nature of the product

1.1. The subject of the transaction is the granting of a right to use software — a result of intellectual activity protected by copyright in the same way as a literary work.

1.2. Computer programs are classified as non-periodical publications and are included in the list of goods of proper quality that are not subject to return or exchange.

1.3. For this reason, once the licence has been delivered, no refund is made on the grounds that the product "did not suit".

2. When the licence is deemed delivered

2.1. The licence is deemed delivered upon the earliest of the following:

  • generation of a licence key and its dispatch to the User;
  • activation of the licence in the software;
  • download of the full version of the software after payment.

2.2. Key generation, activation and downloads are recorded in UniMessenger's logs and serve as confirmation that the licence was delivered.

3. Trial version

3.1. A free trial version is made available before purchase so the User can assess the functionality and compatibility with their equipment.

3.2. The duration of the trial version and the list of products it is offered for are stated at https://unimessenger.ru/en/pricing. The trial version can be downloaded at https://unimessenger.ru/en/download.

3.3. Because an opportunity to examine the product in advance is provided, the sale of the full version does not qualify as a distance sale carrying a right to withdraw from goods of proper quality.

3.4. A trial version may not be provided for certain programs and/or modules — such products are marked at https://unimessenger.ru/en/pricing. For those products a User who is a consumer retains the right to withdraw within 7 (seven) days of delivery under consumer protection law.

4. When a refund is made

4.1. A full refund is made if:

  • payment was made but the licence was not delivered for reasons attributable to UniMessenger;
  • funds were debited by mistake or twice;
  • the software has a material defect that UniMessenger has failed to remedy within a reasonable time after the User reported it;
  • the User withdraws within 1 (one) business day of payment, provided the licence has not been activated and the full version has not been downloaded.

4.2. No refund is made:

  • after the licence has been activated or the full version downloaded, except in the cases set out in clause 4.1;
  • where the User's accounts are suspended by third-party services;
  • where the User's equipment does not meet the system requirements published on the website;
  • where access is terminated because the User breached the Terms of Service;
  • for the unused period where the User withdraws early.

4.3. The following are not defects of the software and are not grounds for a refund:

  • a mismatch between the functionality and the User's subjective expectations, where the software conforms to the description published on the website;
  • the absence of features that are not stated in the product description and were not agreed between the parties in writing;
  • the User's failure to achieve expected commercial or other results from using the software;
  • difficulties experienced by the User in installing and configuring the software;
  • the restriction, modification or discontinuation of Third-party services or of any of their capabilities, as well as changes in operating systems, that affect the operation of the software.

4.4. The User is given the opportunity to verify the functionality of the software and its compatibility with their equipment before purchase, as set out in section 3 of this Policy.

4.5. The software interacts with third-party services — messengers, social networks and other platforms (the "Third-party services"). Third-party services are not under UniMessenger's control, have no contractual relationship with it, and may at any time and at their own discretion change their rules, interfaces and APIs, or restrict, suspend or entirely discontinue individual capabilities.

4.6. If, as a result of actions or changes on the side of a Third-party service, the software loses the ability to perform a particular function — including where that capability has been discontinued by the Third-party service entirely and cannot be restored by technical means — this does not constitute a defect of the software, is not treated as improper performance by UniMessenger, and does not give rise to a refund.

4.7. UniMessenger takes reasonable steps to adapt the software to changes in Third-party services, but does not guarantee that a particular set of features will remain available for the term of the Licence. The current set of features is stated on the website.

5. How to request a refund

5.1. A refund request is sent to support@unimessenger.ru and must include:

  • the User's name and contact details;
  • the date and amount of the payment;
  • the payment method and, for card payments, the last four digits of the card;
  • the grounds for the refund.

5.2. UniMessenger reviews the request within 10 (ten) calendar days of receipt and notifies the User of the decision.

5.3. If the request is granted, funds are returned by the same method used for payment within 10 (ten) calendar days of the decision. The time it takes for the funds to reach the User's account is determined by the issuing bank.

5.4. Refunds are made in the currency of payment. Payment system fees withheld on transfer are not compensated.

6. Consumer rights

6.1. This Policy does not limit the rights of a User who is a consumer under the Law of the Russian Federation "On Protection of Consumer Rights" and other regulations.

6.2. A pre-action complaint procedure is mandatory. Complaints are sent to support@unimessenger.ru; the response period is 10 (ten) business days.
